In this case, we consider whether and under what circumstances a law enforcement agency must disclose to a probationary employee who is a peace officer confidential documents obtained or prepared in the course of a routine background investigation of that officer, conducted pursuant to Government Code section 1031, subdivision (d). In addition to weighing the effect of various statutory provisions and common law principles, we must determine the relevance of the officers express waiver of any right to view the documents in question. We conclude the law gives the officer in this case the right to view the documents, but his waiver of that right is enforceable. Accordingly, we reverse the judgment of the Court of Appeal with instructions to that court to issue a writ of mandate in accordance with our opinion.
